Jury Awards Full Requested Amount in Wrongful Death Case After Motorcycle Training Tragedy
Nance Cacciatore recently secured a jury verdict in favor of the estate of a 72-year-old man who tragically lost his life during a motorcycle training session in Brevard County, Florida.
The decedent was serving as an instructor in a motorcycle safety course when a student rider lost control of their motorcycle. The bike struck the instructor’s leg, causing him to fall backward and strike the back of his head on the pavement. As a result, he sustained a fractured skull and brain hemorrhaging, ultimately passing away 23 days later in the hospital.
The wrongful death claim was filed against the motorcycle dealership that owned the bikes and sponsored the training course on its premises. The defense argued that the instructor had assumed responsibility for the motorcycles and that the dealership was not liable for the fatal injuries.
However, the jury rejected the dealership’s defense and found in favor of the plaintiff, awarding the full amount requested at trial—an outcome that reflects the strength of the case and the jury’s recognition of the dealership’s responsibility.
